RELEASE AND ASSUMPTION OF RISK. ATTENDANCE AT THIS RACING EVENT IS AT YOUR OWN RISK AND COMES WITH RESPONSIBILITIES. Use of this ticket constitutes acceptance of each and all of the following terms. The holder of this ticket acknowledges that the holder is aware of the inherent risk in participating in and attending an event of this type. The ticket holder expressly assumes all risk incident to the event, whether occurring prior to, during or subsequent to the actual conduct of the event including specifically (but not exclusively) the danger of being injured by race cars, race motor bikes, car parts, motor bike parts, support vehicles, etc., and HEREBY RELEASES, waives, discharges and covenants not to sue any participant, sanctioning body, property owner, event manager, KRAVE GROUP, LLC, Eventive Sports Properties, LLC (Eventive), ZOOM Motorsports LLC (“ZOOM”), Barber Motorsports Park, LLC (“BMP”), Barber Vintage Motorsports Museum (“BVMM”), together with their affiliates (including any officers, directors, members, shareholders, owners, affiliates, stockholders, employees, members, managers, servants, and agents of each of the foregoing), and hereby releases any and all of them from any and all claims arising from this event, including claims of negligence of releasees. The holder of this ticket grants permission to KRAVE GROUP, LLC, ZOOM, Eventive, BMP and BVMM to utilize the ticket holder’s image or likeness incidental to any live or recorded television or other transmission or reproduction, or in any photograph or other visual or audible medium whatsoever, in whole or in part, including without limitation my rights of publicity. All rights to broadcast, record, photograph, repeat, reproduce or recreate the event are reserved by KRAVE GROUP, LLC, ZOOM, BMP, Eventive, and BVMM. The ticket holder agrees not to take any action, or cause others to take any action, which would infringe on the rights of KRAVE GROUP, LLC or their designees. Reproduction is restricted to personal use only and any commercial use without the express consent of KRAVE GROUP, LLC, ZOOM, BMP, Eventive, and/or BVMM is prohibited. The holder of this ticket is not entitled to a refund, replacement ticket or to payment for any damages of any kind for any reason from KRAVE GROUP, LLC, ZOOM, BMP and BVMM, including without limitation cancellation, shortening or other alteration of the event. For security purposes, the holder of this ticket hereby consents to the reasonable inspection of his/her person and property before entering and while attending the Event. The holder of this ticket agrees to abide by all rules and regulations established by ZOOM, BMP, Eventive and BVMM and a violation of these rules and regulations can be cause for forfeiture of this ticket and removal from the BMP facility. Tickets obtained from unauthorized sources may be lost, stolen or counterfeit, and if so, are void. The rules for the BMP facility can be found at barberracingevents.com. Seller reserves the right to revoke this ticket and cancel all privileges connected therewith. It is unlawful to reproduce this ticket. Seller reserves the right, without the refund of any portion of the ticket purchase price, to refuse admission or eject any person whose conduct is deemed by Seller to be disorderly, who uses vulgar or abusive language or who fails to comply with these or other applicable rules. ALL SALES ARE FINAL – NO REFUNDS or EXCHANGES – ZOOM, BMP, BVMM, and /or Krave Group, LLC are not responsible for lost, stolen or destroyed tickets. MUSEUM ADMISSION IS NOT INCLUDED.
