RELEASE AND ASSUMPTION OF RISK. ATTENDANCE AT THIS RACING EVENT IS AT YOUR OWN RISK AND COMES WITH RESPONSIBILITIES. Use of this badge constitutes acceptance of each and all of the following terms. The badge holder is aware and acknowledges the inherent risk in participating in and attending an event of this type. The badge holder expressly assumes all risk incident to the event, whether occurring prior to, during or subsequent to the actual conduct of the event including specifically (but not exclusively) the danger of being injured by race cars, race motor bikes, car parts, motor bike parts, support vehicles, etc., and HEREBY RELEASES, waives, discharges and covenants not to sue any participant, sanctioning body, property owner, event manager, INDYCAR, LLC d/b/a INDYCAR (“INDYCAR”), Andersen Promotions, LLC (“Andersen”), Radical Sportscars Limited (“Radical”), United States Auto Club (“USAC”), Eventive Sports, LLC (“ES”), ZOOM Motorsports, LLC (“ZOOM”), Barber Motorsports Park, LLC (“BMP”), Barber Vintage Motorsports Museum (“BVMM”), American Honda Motor Co., Inc. (“Honda”), together with their affiliates (including any officers, directors, members, shareholders, owners, affiliates, stockholders, employees, members, managers, servants, and agents of each of the foregoing), and hereby releases any and all of them from any and all claims arising from this event, including claims of negligence of releasees. The badge holder grants permission to INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda to utilize the badge holder’s image or likeness incidental to any live or recorded television or other transmission or reproduction, or in any photograph or other visual or audible medium whatsoever, in whole or in part, including without limitation, any rights of publicity. All rights to broadcast, record, photograph, repeat, reproduce or recreate the event are reserved by INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda. The badge holder agrees not to take any action, or cause others to take any action, which would infringe on the rights of INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda or their designees. Reproduction is restricted to personal use only. Any commercial use without the express consent of INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda is prohibited. The badge holder is not entitled to a refund, replacement badge or to payment for any damages of any kind for any reason from INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda, including without limitation cancellation, shortening or other alteration of the event. Badges obtained from unauthorized sources may be lost, stolen or counterfeit, and if so, are void. Seller reserves the right to revoke this badge and cancel all privileges connected therewith. It is unlawful to reproduce this badge. Seller reserves the right, without the refund of any portion of the badge purchase price, to refuse admission or eject any person whose conduct is deemed by Seller to be disorderly, who uses vulgar or abusive language or who fails to comply with these or other applicable rules. For security purposes, the badge holder hereby consents to the reasonable inspection of his/her person and property before entering and while attending the Event. The badge holder agrees to abide by all rules and regulations established by ZOOM and BMP as listed on barberracingevents.com, and a violation of these rules and regulations can be cause for forfeiture of this badge and removal from the BMP facility. ALL SALES ARE FINAL – NO REFUNDS or EXCHANGES – INDYCAR, Andersen, Radical, USAC, ES, ZOOM, BMP, BVMM and Honda are not responsible for lost, stolen or destroyed badges.
